Dealing with climate change has become more pressured than ever for various stakeholders in construction projects. As a result, climate change-related legal issues have been seen more frequent in construction disputes. From a question of whether a contractor violates an ESG clause in the FIDIC contract with an employer to an issue of whether a particular storm or hurricane would be regarded as a force majeure event to exempt a contractor from delay damage, the answers and their underlying arguments are never one-size-fits-all conclusions. The panellists will discuss these issues from different perspectives under both common law and civil law.
